PROBLEM BEHIND DETENTION CENTRE RIOT MUST BE REVEALED

         Jakarta, May 10 (Antara) - The riot between security forces and terror inmates at the detention center of the National Police's Mobile Brigade Headquarters (Mako Bromob) in Kelapa Dua, Depok, West Java, on Tuesday night is a grave concern.
         It is an incident which is gravely saddening, especially for the police force, as five of its members were killed. Therefore, the police need to find the reason behind the tragedy.
         According to reports, the riot broke out when several terror convicts, occupying a number of detention blocks, quarreled with police officers over food.
        Chairman of the Association of Indonesian Law Practitioners (Alpha), Azmi Syahputra, assessed that the riot was not merely a matter related to food, and there was a bigger problem that needs to be revealed.
        "The matter related to food that caused the quarrel is merely a trigger. There must be a bigger problem behind the incident. Police must investigate it comprehensively to find the main problem," Syahputra, who is also a lecturer of Criminal Law of Bung Karno University (UBK), told Antara in Jakarta on Thursday.
        He mentioned that the actions of the prisoners were a form of deliberate move, and they must have previously made preparations to do something, considering the right circumstances and time.


       They have deliberately chosen the time when the officer or guard would be less vigilant. In this case, it is at meal time or during breaks. "The terrorist inmates must have considered it to be the right time to start a fight in the prison," he explained.
         He added that the perpetrators are much aware of the conditions and already know the risks and consequences of the move. This is the reason why there were five casualties on the part of police and one on the side of the terrorist inmates. "This reveals that the offenders are aware of the worst consequences of what they do," he elaborated.
         Looking at the incident and their action, it seems that the terror inmates assume their actions or acts as true. They consider the police as an enemy. This is part of the problem. Another thing that becomes the main problem is the counseling and placement of prisoners.
         "So, the Ministry of Law and Human Rights must have different formulations to conduct guidance for prisoners or terrorist inmates." The security in the detention station in Mako Brimob is ineffective, and the prison guidance is not maximal," he explained.
        Moreover, the prisoners do not have the awareness yet or do not feel guilty of what they have done. Here, a touch of humanity is needed. Efforts to provide protection of human rights must be evident, so that the perpetrators will feel that there is still a chance in their life and they can still return to the community. 
   However, the problem arises when the terrorist inmates still see the police as an enemy, making it difficult for the police to provide them with necessary counseling and make them aware (of their mistakes).

        Thus, the Ministry of Justice and Human Rights, through the Directorate General of Prisons, must move quickly and follow its actual task and function in providing counseling to the inmates. "This can be done instead of placing these prisoners under police (detention)," he stated.
         In the meantime, the National Commission on Human Rights (Komnas HAM) noted that the police had taken humanity approach in handling the riot.
       "The police use a soft approach in handling the riot in a fairly tough and long process," Komnas HAM Chairman, Ahmad Taufan Damanik, remarked, through a written statement in Jakarta, on Thursday.
        Damanik added that the police use a soft approach as they take into account female and child detainees in prison. The police handled the hostage-taking incident, which lasted for 40 hours, with great patience.
       All the 155 convicted terrorists were willing to surrender without causing the fall of victims again.
        Damanik also strongly condemned the brutal killing of five members of the police by the terrorist prisoners. He added that the humanist approach of police in handling the act of terrorism is inseparable from the police desire to make improvement and cooperation with various parties, including Komnas HAM.
         Five police officers and one terror convict were killed in the riot.
        A total of 155 terrorist inmates have surrendered to the police officers on Thursday, following two days of deadly riot.
        "The first group of 145 had surrendered without any conditions, and the other 10 had chosen to stay inside (the detention center)," Coordinating Political, Legal and Security Affairs Minister Wiranto said in a press conference at the headquarters on Thursday.
         In the meantime, Comr Gen. Pol. Syafruddin, the National Police deputy chief, remarked that the 155 terror convicts have been moved to the Nusakambangan Prison Island following the riots.
         "We are moving these convicts to the prison island of Nusakambangan," Syafruddin pointed out.
