Jakarta, March 6 (Antara) - The Crescent Star Party (PBB) was not mentioned when the General Elections Commission (KPU) announced last month the eligible political parties to contest in the 2019 presidential and legislative elections.
The PBB was said to have failed in fulfilling the requirements for participating in the 2019 elections. Yet the decision was challenged by the PBB by filing a petition with the General Elections Supervisory Agency (Bawaslu).
The Bawaslu on Sunday night (March 4), ruled in favor of PBB saying it is eligible to take part in the 2019 elections. Therefore, the KPU decided to stipulate PBB as eligible party to contest the 2018 elections.
In its open plenary meeting on Tuesday night the KPU officially stipulated that PBB is eligible to the 2019 presidential and legislative elections. The decision to include PBB as one of the electoral contestants in the 2019 elections followed the Bawaslu's ruling, which had decided that PBB deserved participation in the elections.
Chairman of KPU Arief Budiman noted that the KPU's decision to include PBB on the list of electoral contestant parties eligible to contest the election followed Bawaslu's ruling. He explained that the KPU decided to not to appeal in the State Administrative Court to contest Bawaslu's ruling.
To this end, he remarked that the KPU will make a correction in its letter of decision No. 58/PL.01.1.-Kpt/03/KPU/II/2018 on the stipulation of political parties eligible to contest the 2019 general elections.
"KPU stipulates that Crescent and Star Party is a political party participating in the 2019 general election," KPU Commissioner Evi Novida Ginting explained when reading the results of the KPU Plenary Meeting which was signed by all KPU Commissioners in Jakarta on Tuesday night.
KPU also stipulated the Star Crescent Party as the eligible party to the election with electoral sequence number 19. The plenary meeting also stipulated PBB's electoral sequence number.
PBB received sequence number 19 because the KPU has earlier organized the drawing of the serial number of 14 national parties and four local parties in Aceh that will take part in the 2019 elections.
KPU Commissioner Hasyim Asyari meanwhile noted that the decision was taken to support Bawaslu's ruling as a legal outcome, which had to be implemented based on the general election law.
Moreover, the KPU and Bawaslu constitute election organizers that had their respective tasks and roles based on the law. The KPU is tasked with organizing the elections while the Bawaslu is in charge of supervising it.
The Bawaslu declared in Jakarta on Sunday that the Crescent Star Party had met all the requirements needed to become a general elections participant. Based on it Bawaslu decided to meet the suit filed by the party's general chairman Yusril Ihza Mahendra.
The decision followed an adjudication session led by Bawaslu's chairman Abhan. In the decision read out by Bawaslu member Fritz Edward Siregar it was said that based on the results of factual verification it was found that the party (PBB) had met the requirements needed with regard to its board, 30 percent women representation, domicile of its office and members in the district of South Manokwari in West Papua.
The KPU had earlier declared that PBB did not meet the requirements to be eligible as a general elections participant after it failed to meet verification in South Manokwari.
Following the Bawaslu's ruling, Executive Director of the Association for General Elections and Democracy (Perludem), Titi Anggraini, has urged the KPU to implement a decision by the Bawaslu on the Crescent Star Party (PBB).
"The KPU should implement Bawaslu's decision in accordance with their previous statement, and notably, the KPU will follow up on whatever decisions Bawaslu has taken," Anggraini remarked in Jakarta on Monday (March 5).
The Commission and Bawaslu should establish synergy in order to hold honest and fair general elections, she emphasized. "The KPU and Bawaslu should reach a common consensus on the management of the 2019 general elections to prevent maladministration and embezzlement," she pointed out.
Chairman of Bawaslu, Abhan, had announced on Sunday evening that it had rejected an exception by the KPU and accepted all lawsuits by PBB. Within three days at the latest, the KPU should confirm PBB as a party participating in the 2019 elections, Abhan stated.
The KPU announced on Saturday (Feb 17) to clear 14 political parties (and four local parties in Aceh Province) as eligible electoral contestants for the 2019 general elections, which PBB was not mentioned.
"The KPU has conducted administrative examinations and factual verification of political parties as contestant candidates for the 2019 general elections," KPU Chairman Arief Budiman stated.
Budiman noted that 16 political parties were verified, of which two had failed. The 14 political parties approved by the KPU to take part in the 2019 general elections are the National Mandate Party, Working Party, Indonesian Democratic Party of Struggle, Democratic Party, Great Indonesia Movement Party, Garuda Party, Golkar Party and the People's Conscience Party.
The other parties included in the 14 are the Prosperous Justice Party, Nasdem Party, Perindo Party, United Development Party, National Awakening Party, and Indonesian Solidarity Party.
The Crescent Star Party (PBB) and the Indonesian Justice and Unity Party (PKPI) were the two political parties that failed to pass the KPU selection.
"The PBB and PKPI, on the national scale, do not meet the requirements," Budiman remarked. He said the two parties do not meet the requirements of at least 75 percent membership and management personnel at the district and municipality levels," he added.
