Jakarta, Jan 25 (Antara) - An Islamic university rector has called on the House of Representatives (DPR) to include deviant acts of people with deviant sexual orientation, such as lesbian, gay, bisexual and transgender (LGBT), as a crime that needs punishment.
"We made the appeal because DPR has the task and authority to draft legislation program and discuss bills, including the bill on Criminal Code (KUHP)," Nandang Sutrisno, the rector of the Indonesian Islamic University of Yogyakarta (UII), said in Yogyakarta on Monday (Jan 22).
So far, according to Sutrisno, the deviant acts of LGBT have not yet been regulated in positive laws (national laws in force) as a criminal act, except other specific crimes. The LGBT deviant acts include a lifestyle that disturbs society and jeopardizes the morale and have the potential to spread HIV/AIDS infection. In addition, all religions do not justify LGBT acts.
Therefore, the Islamic University of Indonesia (UII), as an institution of higher education responsible for the morality of the next generation, condemns the effort to legalize the LGBT existence in Indonesia.
"The LGBT deviant sexual orientation contradicts the teachings of Islam, the values of Indonesian society, and the dignity of humanity. It serves as a source of transmission of deadly diseases, such as HIV/AIDS," Sutrisno noted.
The discourse on LGBT issues, which was once taken up two years ago, surfaced again in response to the statement by the People's Consultative Assembly (MPR) Zulkifli Hasan in Surabaya, East Java, on Saturday (Jan 20). Hasan triggered uproar after he claimed that five political parties in the House of Representatives (DPR) had supported a bill to legalize same-sex marriage.
The UII also called on the community to provide social punishment to LGBT actors and their supporters, and to provide political punishment to political parties that support LGBT, by not voting in elections or local elections.
"We also urge LGBT actors to repent in earnest and rehabilitate themselves from LGBT lifestyle addiction, both psychologically and medically," Sutrisno explained.
However, Hasan's statement triggered uproar. Vice Chairman of the House of Representatives Commission VIII Marwan Dasopang questioned the statement of Hasan.
"I condemn the statement of Hasan. This statement is questionable against the truth and the source from which it was obtained," Dasopang pointed out in Jakarta on Monday (Jan 22).
The response also came from House Speaker Bambang Soesatyo who supports efforts to criminalize LGBT deviant behavior and is optimistic that it would be regulated in the Bill on Criminal Code.
"Same-sex marriages that are made public and publicized must be categorized as a criminal act and should be punishable. Hence, an article must be put in place that stipulates the prosecution of LGBT deviant behavioral violations," Soesatyo noted in Jakarta on Tuesday.
Soesatyo revealed that he had met with interfaith leaders, and they had all voiced their opposition to the spread of LGBT behavior in society.
The DPR speaker opined that the state should stop such deviant sexual behavior by formulating stringent rules. "I met with some interfaith leaders. They voiced the same concerns. The state should intervene in private spheres," he remarked.
Commission III of the DPR is still holding discussions on broadening the meaning of adultery and punishment for LGBT behavior. The Commission III is discussing the Draft Law on Criminal Code, in which one of the articles discusses the extension of criminal prosecution against LGBT behavior.
"Our spirit is in the discussion of the Criminal Code Bill in addition to rejecting LGBT, and there is an extension of the punishment of LGBT behavior. Therefore, it is not only the abuse of minors but also the same kind of relationship that can be categorized as immoral behavior," Soesatyo explained.
According to the DPR speaker, various practitioners, religious leaders, and the government had been invited to discuss this matter, and it is expected that the draft of the Criminal Code will be completed before the DPR's term ends in 2019.
"We also invite practitioners of academics and experts, including those from the government, to participate in the discussion," he noted.
Members of the Working Committee on the Draft Law on the Revision of the Criminal Code from the PPP Faction Arsul Sani believes that the prosecution for LGBT should not be for their status as perpetrators but for the deviant behavior they exhibit in public. Sani explained that the extension of the criminal section for LGBT is not only for same-sex relations but also for sexual relations involving the opposite sex.
Accroding to Vice President Jusuf Kalla, Indonesia will not legally recognize the identity of lesbian, gay, bisexual and transgender.
"I do not know what kind of process is carried out in the House, but I do not think anyone would dare to legalize it in Indonesia," Kalla stated in Jakawrta on Tuesday (Jan 23).
Although he does not deny the existence and behavior of LGBT in the country, Kalla thinks it is unnecessary for LGBT to be legalized in order to support the recognition of their identity.
"Yes, it is a reality that they exist as part of the society. However, it is a private business that does not need to be campaigned out or formally legalized," he added.
In the meantime, the Indonesian Ulema Council (MUI) has stated that the statement of the MPR Chairman Zulkifli Hasan on the existence of five House factions that supported lesbian, gay, bisexual and transgender (LGBT) was indeed positive.
The statement reaped protests from various parties, especially from the factions in the House of Representatives (DPR), as they did not want to be accused of being pro-LGBT. "The Chairman of the People's Consultative Assembly has awakened the public on the importance of vigilance against LGBT dangers and free sex behavior," MUI Deputy Chairman Zainut Tauhid Saadi noted in Jakarta on Tuesday.
He has revealed that LGBT and free sex are clearly contrary to cultural values, religion, and the state ideology Pancasila.
Hasan's statement has actually dismissed the allegations of tens of billions of rupiah being funded by foreign agencies to the DPR to legalize LGBT and free sex through the amendment of the articles in the Criminal Code.
It can be proved by the commitment of all faction leaders in the DPR who have declared their opposition of LGBT and free sex practices openly and promised to support the completion of discussion on a bill on Criminal Code, especially in relation to the articles on decency (adultery) and fornication (LGBT).**4*** (A014/INE)EDITED BY INE
