Jakarta, Feb 18 (Antara) -- The intense conflict between the Corruption
Eradication Commission (KPK) and the National Police (Polri) seems to
have been resolved by President Joko Widodo.
Using his prerogative, the President finally decided on Wednesday to
drop the nomination of Commissioner General Budi Gunawan for the post of
the national police chief and replaced him with Commissioner General
Badrodin Haiti.
In January, President Jokowi had named Budi Gunawan as the sole
candidate for the post of the police chief and proposed him to the House
of Representatives (DPR) for its approval. However, several days later,
the KPK named him as a suspect in a case of corruption, alleging that
he had received bribes through suspicious transactions when he headed
the Police Headquarters' Career Planning Bureau in the 2003-2006 period.
Following this, the president decided to postpone installing Gunawan, despite the DPR having approved his nomination.
The anti-graft body had named Gunawan as a suspect only one day before
the parliament conducted a fit and proper test for the police
commissioner general.
To carry out the tasks required of the post, Jokowi had appointed
Commissioner General Badrodin Haiti as the acting police chief to take
over the duties of outgoing police chief General Sutraman temporarily.
Since then, the president has faced pressures from both sides, i.e.
from those who want Gunawan to be installed as the police chief and from
those who urged him to revoke his nomination.
In a move that many saw as a retaliatory action, the Criminal
Investigation Department of the Police Headquarters named KPK Deputy
Chairman Bambang Widjojanto as a suspect in a case related to a regional
election dispute in 2010.
He was charged with prompting a witness to give a false testimony on the election dispute at the Constitutional Court.
The call for Gunawan's installation became even stronger when the South
Jakarta District Court accepted the pretrial suit he filed to challenge
the legality of the KPK's move to name him as a suspect.
The district court ruled that the anti-corruption agency's decision to name him as a graft suspect was illegitimate.
A day after the South Jakarta District Court ruled in favor of Gunawan,
the regional police of South and West Sulawesi announced that it has
named KPK Chief Abraham Samad as a suspect in an alleged document
falsification case.
The KPK naming Gunawan as a suspect and the police doing the same with
leaders of the commission have been seen as a mutual retaliatory acts
that created tensions between the two law enforcement institutions.
In addition, the police force's move to examine 21 investigators of the
KPK for illegal possession of firearms is seen by some quarters as an
effort to weaken the anti-graft body.
To resolve the KPK-Polri conflict, President Jokowi, amid calls for the
inauguration of Budi Gunawan as the police chief, finally came to a
decision that many believe is quite relieving.
He cancelled Budi Gunawan's induction as the police chief and replaced
him with acting police chief Commissioner General Badrodin Haiti,
instead.
"To settle the situation and fulfill the need for a Polri chief soon,
we proposed Commissioner General Badrodin Haiti as a national police
chief candidate to the House of Representatives for its approval,"
President Jokowi affirmed at the State Palace on Wednesday.
On
the occasion, the president appealed to Gunawan to give his best to the
Polri and make the institution more professional to gain people's
trust.
Moreover, Jokowi also announced that he will issue a presidential
decision for the temporary discharge of two KPK leaders. "Following the
presidential decision, a regulation in lieu of law will be issued for
the temporary appointment of new KPK leaders to ensure the smooth
functioning of the anti-graft body," he added.
In accordance with this regulation, Taufiqurahman Ruki, Indarto
Senoaji, and Djohan Budi will be appointed as temporary leaders of the
KPK.
"I
also order the Polri and the KPK to abide by the principles of law and
codes of ethics to maintain harmony between the two institutions," he
emphasized.
Furthermore, political observer from the University of Pelita Harapan
(UPH), Victor Silaen, said he was relieved to hear that President Joko
Widodo had finally decided to not install controversial Commissioner
General Budi Gunawan as the new police chief.
"The
decision to let acting police chief Commissioner General Badrodin Haiti
take over the job is quite a relief, at least for the time being,"
Silaen remarked after the long-awaited announcement was made by the
president.
In
addition, President Jokowi has proposed three new commissioners for the
KPK to replace Chairman Abraham Samad and Deputy Chairman Bambang
Widjajanto, who were both charged by the police for crimes they
allegedly committed before joining the KPK, and another commissioner,
whose term ended.
The three new commissioners are Taufiqurrahman Ruki, Indriyanto Seno Aji, and Johan Budi.
Moreover, DPR Speaker Setyo Novanto said that the parliament respects
President Joko Widodo's decision to cancel the inauguration of Budi
Gunawan as the national police chief.
"I respect the move President Jokowi has taken," he stated at the parliament building.
With regard to the decision made by President Joko Widodo on Wednesday
to nominate Commissioner General Badrodin Haiti for the post of the
national police chief, Novanto pointed out that the president has yet to
inform the DPR about the decision for them to commence further
processes.
He added that the DPR closed the second session for the 2014-2015
period on Tuesday and will be in recess until March 23.
"So the DPR will process the president's letter in the third session," he affirmed.
Earlier, Chairman of the KPK-Polri Independent Consultative Team Ahmad
Syafii Maarif had observed that a real leader must have the courage to
face risks while arriving at decisions.
"There are risks involved, regardless of whether (the president)
installs him (Budi Gunawan) as the police chief. He should act like an
eagle with sharp vision and not like a sleeping cave bat," Maarif told
the media at his Maarif Institute on Tuesday night, the night before the
president finally decided to cancel Gunawan's inauguration.
He pointed out that President Jokowi took a long time to come to a
decision regarding the new police chief, as a result of which the
conflict between the KPK and Polri protracted.
"It is the president who will decide the impact of the conflict," Maarif noted. .
A
former chairman of Muhammadiyah, the second-largest Muslim
organization, and popularly known as Buya Maarif, he suggested that the
president take into account the aspirations of the people while deciding
on whom to name as the new police chief. Jokowi should not bow down to
the pressures he is facing.
Maarif also urged all sides to abide by the laws in force.
"Everyone must respect legal processes. Several legal experts voiced
their critique, but no one should make the water murkier," he remarked.
